Draft. These terms are a reasonable starting point for a free consumer iOS utility and its marketing site. Review with legal counsel before relying on them.

These terms (the "Terms") govern your use of the Volume Booster — Loud Bass EQ iOS application (the "App") and the website at thevolumebooster.app (the "Site"), provided by Appcellent ("we", "us"). By installing or using the App or using the Site you agree to these Terms. If you do not agree, do not use them.

1. Hearing safety

The App increases the loudness of audio it plays. Listening at high volume, particularly through headphones and particularly for long periods, can cause permanent hearing damage.

Sustained exposure above approximately 85 decibels carries a recognised risk of hearing loss, and the risk rises sharply with level and duration. Keep the volume at a comfortable level, take breaks, and stop if you notice ringing, buzzing or muffled hearing. Do not disable your device's own hearing-protection features without understanding what they do. iOS records your headphone exposure in the Health app under Hearing.

The App is not a medical or safety device. It cannot measure your actual exposure and does not replace advice from an audiologist. You assume all risk associated with the listening levels you choose.

1a. Equipment

Amplified audio can distort at high levels and, on external equipment such as passive speakers, sustained heavy distortion may cause damage. Use the App at levels that sound clean, and reduce the boost if you hear crackling or harshness.

2. License

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, and to view the Site. All intellectual property in the App and the Site remains ours or our licensors'.

3. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.
  • Resell, sublicense, or distribute the App.
  • Use the App or Site to violate any law or infringe any right of a third party.
  • Interfere with or disrupt the integrity or performance of the App, Site, or any connected service.

4. App Store terms

The App is distributed through Apple's App Store. Apple's standard End User License Agreement also applies to your use of the App. If there is a conflict between these Terms and Apple's EULA, Apple's EULA governs only to the extent necessary to resolve that conflict.

5. Disclaimer of warranties

The App and the Site are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App or Site will be uninterrupted, error-free, or free from harmful components.

6. Limitation of liability

To the maximum extent permitted by applicable law, Appcellent and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the App or the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the App or the Site will not exceed the amount you paid us for the App in the twelve months preceding the claim (which, for a free app, is zero).

7. Indemnification

You agree to indemnify and hold Appcellent harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the App or the Site.

8. Changes

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date at the top of the page. Continued use of the App or Site after a change takes effect constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which Appcellent is established, without regard to conflict-of-laws principles. Mandatory consumer protections in your country of residence continue to apply.
